that's hazardous material. we can't get to them. >> a triage center was established at a local high school but later evacuated for fear of a second explosion. >> right now, we have tremendous amount of injuries, probably over 100 injuries at this time, at this time. >> fires by the blast burned into the morning. those fires and possible dangerous fumes preventing emergency workers from searching the rubble. >> reporter: latest casualty numbers, 160 people injured at various regional hospitals. the guesstimate on deaths, 5-15. it has just been confirmed that two deaths are local ems paramedics. they are fearing more paramedics may have been lost as well. david scott in west texas, back to you. >> david, thank you very much. we will continue following the story throughout the morning. the "today" show will bring you the latest starting at 7:00. now, to breaking news in san francisco where streets in the

financial district are shut down as the bomb squad looks at a suspicious package. christie smith joins us live with the very latest. christie? >> reporter: good morning. what a morning here in san francisco already. right now, market street is still blocked off. we are in the 600 block. san francisco police are focusing on the 700 block. that's where they are investigating a suspicious package this morning at the same time. there was a large group of people out here dressed in period costumes trying to get down to the fountain to commemorate the 1906 earthquake. they just left and went to a plan "b" a couple of minutes ago. that's because they just couldn't have their shaceremony here at 5:11. at 2:47, san francisco police got a call of a suspicious package on the 700 block of market. they blocked off the streets and evacuated the area as the bomb squad was called in. i just spoke with one of the

organizers of the commemoration about how he found out. >> when i walked out of the side of the palace hotel, a cop was making a beeline for me. i said, i know i look silly in this outlook. i'm in no danger. they told me, go back to the hotel and await further orders. here i am. >> right now, we are waiting for word from san francisco police about the package. what they were able to find out. i asked an officer. is this a bag, a backpack. he said he didn't know. they have at least 12-15 officers out here blocking streets. in the meantime, that 5-11-06 commemoration, everyone took off in their antique cars and costumes a couple of minutes ago, went whizzing down market street. they are going to go ahead and hold the commemoration over at union square for the time being. that's the latest from here reporting live in san francisco, christie smith, "today in the bay." in the meantime, we also continue to keep an eye on

boston where the investigation is ongoing. this morning, president obama and the first lady will travel to boston where they will attend a prayer service and meet with first responders. >> the president will also meet with state and local officials. that visit comes as investigators hone in on a suspect. they are examining surveillance video from a department store that shows a man dropping a bag or backpack near the site of one of the explosions. as for the bombs, we have learned at least one of them was powered by a battery made by a fremont company. they make the battery found at the blast site. it is commonly used in remote control cars. in the meantime, a bay area boy injured in the bombing is still hospitalized after his second surgery. 11-year-old aaron hern from martinez has serious leg wounds. he is trying to communicate with them using a touch pad. local running groups are pulling together this morning in support of the victims.

the organizers have planned a three-mile run for tonight, one mile for each victim. it will start at the store on college avenue at 7:30 and end in snow park. once there, runners will hold a moment of silence to honor the victims of the explosion. as always, we will continue to follow new developments surrounding the explosion throughout the morning here on "today in the bay" and our website, nbc bay area.com. the attorney for the family of 15-year-old audrie potts speaking out today against the los gatos saratoga union high school district after an alleged sexual attack that was photographed last fall. the saratoga high student killed herself days later. the pott family is taking legal action to say it needs to be held accountable for failing to properly handle audrie's case. marla tallez is in the newsroom with the latest. today, the pott family attorney, robert allard, is making himself available for questions surrounding the new legal claim that was just filed by the pott family. they are accusing teachers and

administrators at saratoga high school for a number of shocking allegations. the first one, the pott family says the district did not act when they knew 15-year-old audrie pott was being bullied. famtly the family is accusing the saratoga high school principal of prematurely accusing them while she was alive. the principal says awudrie's stepmother gave him permission to do so. they did nothing to stop the bullying. >> the key for what the pott family is looking at is, did the school know that audrie was being bullied? if the dissemination of the photographs and the bullying occurred on campus between

students, then that's something that the school perhaps should have prevented. >> the story broke just last week when three 16-year-old boys were arrested for allegedly assaulting audrey pott at an unsupervised house party. the boys are accused of taking pictures and then distributing them at school eight days later. she hanged herself. now, in regard to the new legal claim, the school district has issued a pretty lengthy statement. i will get into this in my next report including why the district says the boys were not disciplined right away. >> thank you very much, marla. it is 5:09. we will check in with meteorologist, christina loren. after a few windy days mother nature is sprinkling sunshine and warm weather along our way. >> you can get on out there and enjoy it comfortably on the beach. temperatures and wind will play a factor for the first part of the day. the winds are going to increase

evacuating the rest home and helping them, getting the critical ones to the hospital here. it was just crazy. >> this is all after an explosion in west texas. it is breaking news. we continue to follow this morning about 160 people have been injured. as many as 15 dead so far. that count certainly could go up at least two of those that have been killed were ems crews that were on the scene of a fire at a fertilizer plant. the search continues for survivors. we will have live updates coming up. it is 5:14 right now. you might say this one is not a threat. it is a promise. one of san francisco's most powerful men says he will punish senators that voted against the new gun control law. scott mcgrew and ron conway promising to fund their opponents coming up at the next election. >> he definitely has the funds to do it. conway is an angel investor, arguably, the second most powerful person in san francisco

behind mayor ed lee. he is an early investor in all kinds of tech, including twitter. he told the san francisco chronicle, he is so angry about wednesday's vote in the senate, he will help candidates defeat senators that voted against expanded background checks. google reports profits today. do watch for increased costs. larry page has always said he wants google to change the world, not necessarily make money. now, the company makes a tremendous amount of money. while that is important to investors, it is not important to larry. google telling app developers interested in its new glass device, the company is going to be much more restricted than it is for android apps. android, you can do pretty much anything you want. glass, no, no advertisements and apps will have to be approved ahead of time. new users are also discovering it is going to be difficult to sell your google glass to someone else, because they are associated with one google account and that's not transferrable. >> let's get a check on markets.

mary thompson live at cnbc world headquarters. good morning, mary. >> good morning to you. futures are higher across the board following wednesday's selloff. yesterday's action marked the third straight move as it fell 138 points to close at 4,618. the nasdaq dropping 60 points to finish at 3,204. commodities continuing to be vol tid. crud this seems like the perfect end to the housing crisis. some homeowners that got settlement checks after that big multi-bank lawsuits say the checks bounced. no one got very much money. the company charged of disbursement tells "the new york times" it made a mistake. it has been fixed. the checks will go through. but somehow that just seems like --

following a powerful earthquake earlier this week. at least 35 are dead. 150 others hurt. pakistan's army is helping rescue crews dig through the rubble looking for survivors. the magnitude 7.8 struck on tuesday. two powerful aftershocks rocked that area yesterday. >> now, to an investigative unit exclusive. there could be surprises for people that don't have insurance under the new federal tax care act. this comes at tax time. steven saw a little wrinkle in the new health care law that involves the irs and you. the man who oversees the irs says the agency now needs to do a better job at getting the word out. the law is known as the affordable care act. you have probably heard of that. few people outside of lawyers and accountants and the offices actually know it will penalize many people who do not have health care insurance by docking their tax refunds.

that, says the man who oversees the irs, presents a problem. he says the agency has not publicized this penalty as much as it should. >> many americans do not realize the extent that the internal revenue service will be involved in the implementation of the affordable care act. >> the irs would not comment on the inspector general's criticism. they are getting ready to place enforcements in this new law. president obama asking congress for $440 million to help the irs get ready to oversee this part of the health care law. coming up tonight, steven stock breaking down this new law in extreme details. he has the list of penalties that you will have to pay if you don't have health insurance. that's coming up tonight at 11:00. 5:21. l.a. county sheriff's employees getting a demotion. they are accused of cheating at a charity relay race.

welcome back on a thursday morning. a live look from the south bay. that is the hp pavilion, home of your san jose sharks tonight. hosting the wild from minnesota hoping to keep things going if the playoffs get close. it is 5:23. several los angeles county sheriff's employees being demoted for allegedly cheating at a charity relay race. the punishment stemming from last year's baker to vegas foot race where different law enforcement agencies compete with a run through the mojave desert. this time around, the l.a. county sheriff's team brought in a fast ringer to run for them. five people have since been opini punished including three department supervisors who have been demoted. total woman gym and spa has started construction on a new

they are right there at that dubl dublin interchange. look at the big slowing developing. slowdowns coming out of livermore. that might make 84 get more busy as folks cut out through livermore. we are looking over toward the bay bridge with no major delays. over to the city side, we have the closure on market for the one block between kearney and grant. we are looking over toward the bay bridge toll plaza with the backup not yet forming in the cash lanes. interstate 80 through dixson eastbound, a very serious accident closing for a medical helicopter. in the north bay, your commute dpre direction. back to you. thank you very much, mike. more questions and concerns this morning over those busted bolts on the new bay bridge. the sacramento bay is reporting some steel anchor bolts produced in 2010 for the bridge failed the same quality test as the

bolts manufactured five years ago which broke last month. the results contradict earlier statements by the california department of transportation saying only bolts produced in 2008 had failed tests. last month, more than 30 bolts snapped after being tightened on the new eastern span of the bay bridge. it is 5:26 right now. we continue following two pieces of breaking news this morning. kris christie smith has just talked to police. she will have the latest on the street shut down in san francisco for a suspicious package. a small texas town, crews are now going door to door trying to find missing people after an explosion at a fertilizer plant

a desperate search for survivors in west texas. a small town leveled after an explosion at a fertilizer plant. at least 160 people are injured. as many as 15 dead with more expected. dozens of homes and buildings completely wiped out. this morning, the search is on for people still missing, including officers and firefighters. >> it was just about 5:30. good morning, everybody. we appreciate you joining us. i'm jon kelley. >> i'm laura garcia cannon. details are still coming in. this morning, we are getting a better idea of just how large this explosion was. people, more than 70 miles away from the town of west say they felt that blast. it was so large, the usgs says it registered the same as a 2.1 magnitude earthquake. in that town, a lot of people are using the words, extreme devastation. >> police seeing that blast leveled homes for blocks. with the sun coming up, they are still looking for survivors. the firefighters fighting that initial fire at the plant. they are missing as well as

police officers that were working the scene. other emergency responders going from business to business right now, house to house this morning, still looking for any survivors that may be out there that they can help and help is poring in from nearby towns. "today in the bay's" david scott is in west texas. we will check in with him for a live update coming up in a few minutes. breaking news. san francisco ace bomb squad has just given the all-clear for a suspicious package found in the financial district. kiss christie smith is live. >> reporter: market street is back open, shut down for a couple of hours. they opened it 5, 10 minutes ago. an officer pulled down the tape. what they are telling me is that the suspicious package on the 700 block was actually a suitcase. it was left closed. that's why they are being so

cautious. people are going to be gathering there this morning. that's why they brought in the bomb squad. the fountain is where the 1906 earthquake explosion is supposed to take place. the commemoration, instead, moved to union square at the last minute. now, what happened, about 2:47 this morning, san francisco police were notified about that suspicious package. an officer tells me they sent in a robot. it just turned out to be a harmless suitcase. i asked what was inside. that officer said he didn't know but they evacuated the area as a precaution. many people just standing by waiting for that commemoration to start this morning, waiting in period costumes but they suddenly took off in antique cars. again, over to union square. san francisco mayor, ed lee, sent out a tweet saying they are continuing that commemoration there this morning instead. for now, the all-clear is given

and market street is back open. reporting live in san francisco, christie smith, "today in the bay." >> let's take you live to boston medical center. an update on the condition of people injured in that blast on monday at the finish of the bos ton marathon. let's listen in. >> families. we wanted to be here to answer any questions about that. we are really working hard to make sure everybody gets the care they need. >> can we taupe up to questions? >> so obviously the people who were there, the spectators and the runners, are going to have emotional trauma. things happening. what about the first responders. what sort of trauma. a lot of them in the tent then went to the hospital where they worked and have just been working. when should they expect to start processing or feeling that? >> basically, right away. our social work department and my group has been holding

debriefings to debrief our staff. i met with people in the emergency department to debrief monday's event. the emts present there joined us. we are constantly trying to engage staff in that. that's an ongoing process. people are already starting to feel the emotional impact. >> what is that like, the emotional impact? what does that look like? >> right now, we are listening live at boston medical center. officials talking about the victims of the bombing on monday. updating us on those conditions. the totals we have from the boston medical center, 16 people still at the hospital being treated. one remains in critical condition. 12 in serious condition, three in fair and two are still in surgery and being worked on. once again, boston marathon being updated from boston medical center. we want to now give you the latest on the bombing. investigators, authorities now honing in on a possible suspect this morning. investigators say a department

store surveillance camera recorded a man dropping a bag or backpack at the site of the explosion, in both explosions. president obama and the first lady will be in boston to offer their support. they will meet with first responders and state and local officials. we are learning more about one of the victims killed in the bombings. . lu lindzi was a boston national. people in her hometown have been expressing sorrow and sympathy for her entire family. we will continue to follow the developments. a live report coming from boston in about ten minutes. 5:35. san mateo taking a step to better prepare themselves for a major emergency. more than 20 agencies taking part in a county-wide emergency drill. it will test the county's

ability to mass distribute medicine from the u.s. center for disease control. officials will go door to door visiting more than 15,000 homes to simulate handing out medicine in the event of a flu pandemic or biological attack along with food or water-borne illnesses. breaking news in west texas. new details emerging as emergency responders going door to door trying to find survivors of the deadly fertilizer plant explosion. david scott live in the town of west. david, we are curious what are you hearing this morning as of right now? >> reporter: well, i'll tell you, they have been going door to door and searching through rubble all night long. now, at least, they have the benefit of the dawn's early light. we have also had a heavy cold rain squall just move through here. that cannot help the search and rescue whatsoever. latest count, 160 injured. guesstimated dead, 5-15. at least two of those are ems

paramedics. they fear they may have lost more paramedics as well. the search will go on here all day long. about half of the 2800 people who live here were evacuated overnight for fear of toxic fumes. >> david, we are hearing this morning that there are reports that that fertilizer plant was cited for a permit violation several years ago. what do you know? what can you tell us about that? >> i know a bit. this goes back to 2006. they apparently didn't file for or submit the proper paperwork. the he can logical divisions of the government looked into it. they got things squared away. we don't know what caused the thing last night. there was a small fire at the plant, about 45 minutes before the explosion. as you know, fire, ammonia, fertilizer don't mix very well. they will go over the scene with a fine tooth comb as they can get to everything and get some answers. a large contingent of federal

80 inland. a lot of folks getting out the front door here. fremont, by the truck scales, north of the tesla plant at mission boulevard, an increase for the southbound head light side. the northbound side also picking up a number of cars. the big east bay troubled spot. the significant alert declared for west 580 back over here toward the dublin interchange. as we are looking westbound, we still have the slow lane blocked by a crash involving a big rig and another car. it sounds like some extensive injuries to at least one person there. i don't know which vehicle the person was in. 101, we'll send it back to you. >> thanks a lot, mike. the time is 5:39. the man accused of kidnapping and killing sierra lamar. we will let you know why he

right now, we take you back to boston. this is from the boston medical center. on monday, you recall two bombings at the finish of the boston marathon. the officials there updating us on the status of victims that remain at the hospital. a lot of people have been released. the boston medical center, we are being told 16 patients still there, one of them in critical condition. three of them in fair condition. two remain in surgery. a total of 12. a dozen people still in serious condition. we will keep you updated on everything happening in boston. it is 5:42. the president and first lady will visit boston today to try to lend comfort and support following monday's fatal bombing at the boston marathon. in the meantime, a big break

that has investigators closing in on a suspect. chris pollone joins us. >> reporter: a big day for healing and comfort for the people in boston, anxious to see some sort of an arrest. the president and the first lady will land in ban hour for ar inter-faith prayer vigil. the president is expected to speak toward the end of the service. this is a time obviously of great tension. people in boston wanting to see some sort of break. it appears one big break happened yesterday. that is rights tell nbc news that they have honed in on a potential suspect spotted in a surveillance camera video that was taken from a department store across the street from where the second bomb went off. authorities tell nbc news that they have sfotpotted a man on h cell phone in that video.

he appears to put down a black backpack or duffle back on to the ground. they have said before that it appears that both bombs were placed inside some sort of black nylon backpack. that's how they are tying this person to the scene. the next is to try and identify who that person is, where he might be, where he may have come from, who he is tied to. that's what we assume they are doing today. it would be interesting to see if they release this photo to get the public's help in identifying him. we expect this to continue moving forward. fbi technicians were seen balking down boyleston street looking for any piece of the bomb they could find to put it back together and determine where the components were bought. that may be another way of tracking down this suspect. laura, i'll send it back to you. all right. chris pollone, live in boston. we will continue to follow new

developments surrounding the explosion here on "today in the bay" and on our website, nbc bay area.com. the family of 15-year-old audrie pott has more than a few words for the school district they say failed to do anything to stop their daughter from being bullied. her suicide last fall now coming to life after three 16-year-old boys were arrested for allegedly sexually assaulting her, taking pictures of the incident and leaking those photos on the saratoga high school campus. the pott family now preparing to take full legal action against the district. "today in the bay's" marla tallez is in our newsroom with reaction from both sides. marla, good morning. the pott family has just filed a new legal claim against a los gatos, saratoga high school district. the family is getting ready to file an official lawsuit. a slew of shocking allegations. the first one, the potts say the district did not act when they knew 15-year-old audrey pott was being bullied. they discuss the issue with the

saratoga high school principal. our internal investigation showed that awudrie never sough counseling. audrie hanged herself a little over a week after pictures of her alleged sexual assault spread throughout her high school. our legal analyst says, there is one key question here. dissemination of the photographs and the bullying occurred on campus between students. then, that's something that the school perhaps should have prevented. >> the 16-year-old boys accused of the sexual assault were arrested last week. two were dropped from the high school football team but never disciplined otherwise. as for why they were not suspended or expelled, the district's statement reads, quote, school districts cannot expend or expel someone based

solely on alleged behavior outside of school, end quote. if you would like to read all four pages of the school's response, it is pretty lengthy. today, the pott family attorney will be answering questions about this brand new legal claim. jon and laura? >> thank you very much. i want to turn to meteorologist, christina loren. she has a look at our forecast today. >> i get to be the bearer of good news on an otherwise sad start to a thursday morning. we have a lot to talk about in the weather department. really, no severe weather headed our way until we hit this weekend. it won't be that severe. i am talking about the kind where you will need to use your a.c. you could overdo it if you spend too much of your energy outdoors. we are talking about temperatures in the 90s. the warmest weather of the year so far just around the corner. big ridge of high pressure moves in today. i want to start this live picture, san jose, to show you the twinkling lights.
